GENERAL TERMS AND CONDITIONS OF CONTRACTING

1. Identification of the Organiser

These General Terms and Conditions govern the contractual relationship between the client and 4DROAD S.L. (hereinafter "4DROAD"), a travel agency duly licensed under licence number CICMA 4980, with registered address at Glorieta Ruiz Jiménez 2, 28015 Madrid, Spain, NIF B25896788, email: contact@4droad.com, phone: +34 614 878 852.

4DROAD acts as the organiser of all travel packages offered on its website, in accordance with Spanish and European legislation on combined travel.

2. Scope of Application

These conditions apply to all travel packages organised and commercialised by 4DROAD, including trips to Kyrgyzstan and any other destinations offered on the website www.4droad.com.

By making a booking, the client accepts these General Terms and Conditions in full.

3. Booking Process

The booking process is as follows:

  1. The client contacts 4DROAD via the contact form or email to request information about a trip.

  2. 4DROAD provides the client with a personalised quote detailing the services included, dates, price and payment conditions.

  3. The client confirms their intention to book by making the first payment as described in Section 4.

  4. 4DROAD confirms the booking in writing (by email) once the first payment has been received.

The booking is only confirmed and binding upon receipt of the first payment and the written confirmation from 4DROAD.

4. Price and Payment Conditions

The total price of each trip is detailed in the personalised quote provided to the client.

Payment is structured as follows:

  • First payment (50% of total price): Due upon booking confirmation. This payment secures the client's place on the trip.

  • Second payment (remaining 50%): Due no later than 2 months (60 days) before the trip departure date.

All payments are made by bank transfer to the account details provided by 4DROAD in the quote or booking confirmation email.

Failure to make the second payment by the established deadline will be considered a cancellation by the client, and the conditions set out in Section 5 will apply.

5. Cancellation Policy

5.1 Cancellation by the client

All cancellations must be notified in writing to contact@4droad.com.

Regardless of the date of cancellation, the first payment (50% of the total price) is non-refundable, as it covers organisational, coordination and administrative costs already incurred by 4DROAD.

If the client cancels after the second payment has been made, the following conditions apply:

  • Cancellation more than 60 days before departure: loss of the first payment (50%). The second payment will be refunded.

  • Cancellation between 60 and 30 days before departure: loss of 75% of the total price.

  • Cancellation less than 30 days before departure or no-show: loss of 100% of the total price.

5.2 Cancellation by 4DROAD due to force majeure

In the event that 4DROAD is forced to cancel a trip due to force majeure or extraordinary circumstances beyond its reasonable control (including but not limited to natural disasters, political unrest, armed conflict, border closures, health emergencies or government travel advisories), 4DROAD will refund 100% of the amounts paid by the client for the trip package.

This refund covers only the amounts paid directly to 4DROAD. It does not cover flights, visas, travel insurance or any other expenses arranged independently by the client.

4DROAD will not be liable for any additional costs or losses incurred by the client as a result of such cancellation.

6. What Is Included and Not Included

Each trip package clearly specifies what is included in the price. Unless expressly stated otherwise, the following are not included:

  • International or domestic flights.

  • Travel, medical or cancellation insurance.

  • Visa fees and related costs.

  • Personal expenses.

  • Any services not expressly mentioned in the quote or booking confirmation.

4DROAD strongly recommends that all clients take out comprehensive travel insurance, including medical cover and trip cancellation cover, prior to departure.

7. Client Responsibilities

The client is solely responsible for:

  • Ensuring they hold a valid passport and any required visas for the destination.

  • Complying with the entry requirements of the destination country.

  • Ensuring they are in adequate physical and mental condition to participate in the activities included in the trip.

  • Informing 4DROAD of any medical conditions, dietary requirements or special needs at the time of booking.

  • Behaving in accordance with local laws, customs and the instructions of the local guide or operator.

4DROAD reserves the right to exclude a client from a trip at any time if their behaviour endangers the safety or wellbeing of other participants or the local team, without any right to a refund.

8. Local Partner

For the on-the-ground execution of services in Kyrgyzstan, 4DROAD works with a carefully selected local partner company. While 4DROAD takes all reasonable measures to ensure the quality and safety of services provided, it shall not be held liable for acts or omissions directly attributable to the local operator that are beyond 4DROAD's reasonable control.

9. Modifications to the Trip

4DROAD reserves the right to make minor modifications to the itinerary when necessary due to operational, safety or logistical reasons. The client will be informed of any significant changes as soon as possible.

If a significant change is made before departure and the client does not accept it, they will be entitled to a full refund of all amounts paid to 4DROAD.

10. Complaints and Claims

Any complaint or claim must be notified to 4DROAD as soon as possible during the trip, to allow 4DROAD to seek an immediate solution.

If the issue is not resolved during the trip, the client may submit a formal written complaint to contact@4droad.com within 30 days of the end of the trip.

4DROAD will respond to all formal complaints within 30 days of receipt.

11. Data Protection

Personal data provided by the client will be processed in accordance with 4DROAD's Privacy Policy, available at www.4droad.com/privacy-policy, and in compliance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

12. Applicable Law and Jurisdiction

These General Terms and Conditions are governed by Spanish law, and in particular by Royal Legislative Decree 1/2007 on the Protection of Consumers and Users and Law 4/2023 on Combined Travel and Linked Travel Arrangements.

For disputes with consumers, the competent courts shall be determined in accordance with applicable consumer protection legislation.

For disputes between companies, both parties submit to the Courts and Tribunals of Madrid.
